Both Cynical - and Wrong Pscylops et al...Everything with you people always seems to have an agenda, people being in cahoots with others, ramping, deramping etc etc..You'd find a conspiracy in a singles' club.All it takes is one afternoon's posts replying to Daviduzbek and you think I'm sh*gin him. What a set of small-minded jokers.I'm interested in MY investment. You should be in yours, so keep yer nose out.If this case was simple and based on all the details that are in the public domain from the Oxus point of view,, this would have been done and dusted ages back.The things that are in the public domain are the easy parts. What I'm interested in are the parts NOT in the public domain ie The Uzbek's case. Re-read and look at my posts again - I am asking questions. Simple as. I am not stating anything. Ultimately you're all the victims of the result, and that could be good or bad.Regarding corruption and jurisdiction - you are SO naive...and I am not saying this happened. I am curious as to whether it did or not and on what level.The Yukos case (among others ) also presented corruption - and had patently passed the initial jurisdiction test !!! But it WAS a factor in the final outcome.

The Facts. This could lead to the throwout of the entire case ala Metal Tech (which has some unsettlng parallels) or reduction in payout (ala Yukos, which has some very nice parallels)" alluding to the Metal Tech vs Uzbek ICSID case and mentioning bribes in connection with the OXS vs Uzbeks UNCITRAL case pennyfalls (and daviduzbek) ARE POSTING A LOAD OF COMPLETE RUBBISH!! These are the facts:[link] "On 4 October 2013, an ICSID tribunal rendered its decision in the investment treaty dispute between the Israeli company Metal-Tech Ltd. and Uzbekistan. In the award, the tribunal found that it lacked jurisdiction to hear the parties’ claims and counterclaims brought under the Israel-Uzbekistan BIT and Uzbek law due to corruption related to Metal-Tech’s investment in Uzbekistan. In particular, the tribunal found that payments of approximately USD 4 million made by Metal-Tech to several individuals, including an Uzbek government official and the brother of the then Prime Minister of Uzbekistan, while presented as remuneration for various consultancy services, in fact constituted corruption and were illegal under Uzbek law." From the OXS RNS dated 14/11/12 Update on Arbitration Proceedings[link] "The Company provides the following update on arbitration proceedings which complies with the Order of the Arbitral Tribunal dated March 19, 2012 on the confidentiality of the arbitral proceedings. The Arbitral Tribunal has held that Oxus has standing under the bilateral investment treaty between the United Kingdom and Uzbekistan dated November 24, 1993 (the "BIT" to bring its claims for expropriation as direct and indirect shareholder of the non-UK subsidiaries that have made the investment in Uzbekistan." If OXS had acted corruptly (like Metal Tech had) by paying bribes it would have invalidated the bilateral investment treaty between the UK & the Uzbeks rather like Metal Tech paying bribes had invalidated the bilateral investment treaty between Israel & the Uzbeks. The fact that "Oxus has standing under the bilateral investment treaty between the United Kingdom and Uzbekistan dated November 24, 1993 (the "BIT" to bring its claims for expropriation" means the BIT WASN'T INVALIDATED BY ANY CORRUPT PAYMENTS!!!!!!!!!!!!!!!!! Hence I believe it is safe to conclude with 100% certainty that OXS did NOT make corrupt payments. If they had then the UNCITRAL arbitration panel would have stated it lacked jurisdiction to hear the OXS claim.

Re: ***What the .....!!!*** Psyclopes, good post. Your exactly right and what appears to be conveniently forgotten (by some) is that Oxus won the jurisdiction. Metal-Tech's case didn't get past the jurisdiction stage because of bribery / corruption. To think that White and Case would not bring up bribery/ corruption if they could at the jurisdiction stage is someone who is either ill-informed or simply mischief making. Additionally, Calunius would have done due diligence and sought guarantees on bribery issues prior to taking the case on and they also have the right to drop the case at any stage.

Re: ***What the .....!!!*** What is also basic Penny/Petty is that the Anti Bribery and Corruption act of 2010 takes precedent over all else and if OXS are shown to have even paid a "facilitation fee" then the BoD and individual are liable for prison.To be covered by this act one only needs to have a single employee based in the UK to have it's entire business globally under scrutiny and any payments made to a government official (as would almost be a certainty in the case of OXS paying a fee to operate/gain the licence) are seen as especially high end offending.It would seem that you and David are the embodiment of idle hands make for devil's mischief.David Uzbek is proven to have stretched the truth and his connections to the company and was outed some time ago by Richard Wilkins and you were recently put in your place by the same man.You know they read these boards and you know they are pretty hot on BS being spread so I suggest you both take a step back from spouting around bribery as fact when in fact the very you carry on a conversation in a public forum on this leaves you both open to Libel as there certainly is no evidence to support this - do you think we would be approaching 18 months after the final hearing if this was actually a factor? Do you not think Ms Lam would have found this and had it thrown out?Think about things for a bit...

Re: Phone number - sent you e-mail Inda...)But here's the gist..I won't be reporting anything on here regarding the conversation I have with David Uzbek..But what happens if, in the course of talking to DavidUzbek, or any man in the pub who used to work for Oxus, or an ex worker, or an auditor , or an official etc etc..., that information is picked up that could be useful ..or vital..?What If I heard something that afterwards I said; " Oh I sold all mine, I knew that might happen"..Very very unlikely, but I'v egot to say that this type of censorship of thought and what 's deemed to be acceptable and Message Boards crucifixion of Persons non Grata is baffling to me..All you should care about is KNOWLEDGE - good and bad. I don't get the angles on these boards many times.Why have you such a downer on DavidUzbekand such a tainted view, based on what? His having a negative outlook? How do you know he hasn't more to base that on than your positivity?if he worked in Uzbekistan I'd rather hear his views than most of the voices on here. He's more qualified to give background on the country, is he not?

***What the .....!!!*** I'm sorry guys (Bbanker et al), but ANYONE who does not know that Oxus were producing should not be here at all..This is BASIC.When people say DYOR, what does that mean? It means read the company accounts and reopors at the very least and learn something.To now know Oxus has been producing for years - I am staggered. This is THE ARBITRATION CASE!

Re: Fao Louise I had not realised that they were producing. That is really good news. Surely the shareholders will get something out of this as they have been stitched up to date. The legal process has taken far too long but the end must be close.

Re: Phone number - sent you e-mail Hi Indaknow..With all respect I take it that you have never met or talked to DavidUzbek, so, although you may have views on what he knows, doesn't know, past background and jobs, what do you actually know about him ?You're making a lot of assumptions. Put it this way, I'd rather talk to David, and find out myself, than have an armchair critic , who doesn't even know him personally, judge what he does or doesn't know. I don;t see what the problem is..I'm not looking for anything specific about the Oxus case, but I like learning things, important or not.You only find out and make a rounded view by asking. Most stories aren't the ones you expect to hear and are just picked up by throwaway remarks, and if I learn one interesting thing, then it's been worthwhile.I just want to talk to him and have a chat, it's that simple

He's not seen the contract, not actually seen any corruption take place with his own eyes, not part of the arbitration hearing.. I'm sure he'll be very knowledgeable...

Fao Louise I'm not sure if you were taking the mick with your last message Lou, but you do realise that Oxus have been producing gold and silver in pretty large amounts since they started there - originally exceeding expectations of production.It may seem boring but if you look through all the past years reports, it's all there..Good luck
